Creator Content Licensing Terms
1. Parties and acceptance
These Creator Content Licensing Terms (“Terms”) form an agreement between Next Hits FZC LLC, an Ajman Free Zone company operating YaSalam (“Company”), and the registered account holder uploading content (“Creator”). They apply when a Creator actively accepts these Terms and uploads audio or associated materials to yasalam.music. The Company should make the current version available before acceptance.
The Creator must be legally able to enter this agreement; where a minor may use the service, an appropriately designed guardian consent and age policy is required before uploads are enabled.
2. Permitted content and rights
The Platform is intended for original, unreleased musical compositions, demos and recordings and, subject to separate rights clearance, newly recorded cover performances for talent showcasing. The Creator warrants that they own or have obtained all permissions needed for the submitted musical composition, lyrics, master recording, performances, samples, artwork and other incorporated material.
The Creator must not upload unauthorized commercial masters, sampled recordings, instrumentals, backing tracks or third-party content.
Co-authors, performers, publishers, producers and labels may hold independent rights. A declaration alone does not substitute for their authorization.
3. Ownership
As between the Creator and Company, the Creator and other applicable rightsholders retain all ownership of their content.
Uploading does not transfer copyright or ownership to the Company.
4. Limited platform licence
For so long as content is made available under these Terms, the Creator grants the Company a worldwide, non-exclusive, royalty-free (as between Creator and Company), sublicensable only to technical service providers acting on the Company’s behalf, licence to host, cache, store, reproduce as technically necessary, transcode, secure, display accompanying metadata and stream the content solely to operate, maintain and provide the YaSalam service in accordance with the Creator’s selected access settings. This grant is only to the extent the Creator controls the relevant rights.
“Public” means accessible for playback to registered YaSalam users, not unregistered visitors. “Private” means accessible only to registered users specifically authorized by the Creator, subject to necessary platform administration and legal/security processes. Changing access settings will apply prospectively, subject to reasonable technical processing.
The Company receives no right under this clause to sell, synchronize, commercially distribute, independently license, exploit in advertising or train generative AI models on Creator content.
Such uses require separate express authorization and any additional rightsholder permissions.
5. Covers
A cover is a newly recorded performance of an existing musical composition. The Creator may own their new recording but does not thereby own the underlying composition.
Covers may be uploaded for showcase only if all necessary permissions for hosting, reproduction, communication/making available and streaming have been obtained and can be evidenced on request.
Until the Company establishes and verifies an appropriate cover clearance process, cover uploads must not be enabled for streaming, whether public or private. Showcase-only and no direct charge do not eliminate copyright obligations.
6. Rights evidence and enforcement
The Creator must supply accurate title, authorship, ownership, contributor and licensing information and reasonably requested supporting evidence.
The Company may suspend or remove content, restrict accounts, or seek further evidence where rights are disputed or unclear. False statements or repeated infringement may result in account termination.
7. Removal and termination
The Creator may request deletion or remove content through available controls.
The platform licence for future playback ends when content is removed or the account is terminated, except for limited backups, evidence preservation, legal obligations, existing authorized transactions and reasonable technical wind-down, without permitting new public playback.
8. Responsibility and applicable law
Each party remains responsible for its own conduct under applicable law. Nothing in these Terms overrides mandatory rights or statutory licensing requirements in the territories where content is made available.
Any additional liability, dispute resolution, governing law, privacy and account provisions should be aligned with the final platform-wide Terms of Service by qualified UAE counsel.
9. Electronic acceptance
Required checkbox (unchecked by default): “I confirm that I own or have secured all rights necessary for this recording and its underlying music, have read and accept the Creator Content Licensing Terms, and authorize YaSalam to host and play it according to my selected access settings.”
Store user ID, content ID, exact terms version/hash, UTC timestamp, acceptance event, selected visibility, and supporting rights documents securely.
Require re-acceptance for material changes. Do not pre-check the box.
